1. ORGANIZER OF THE CAMPAIGN. GENERAL TERMS & CONDITIONS OF THE CAMPAIGN
1.1. The organizer of the Promotional campaign „Hobo Lottery” (hereinafter referred to as the “Campaign”) is: Hobo Bulgaria LLC, registered in the Commercial and NPLE Register at the Registry Agency under UIC 205420451, having its seat and registered address in Sofia 1000, 31 Angel Kanchev Str., (hereinafter referred to as “Organizer”). The Campaign is organized with the financial support of Visa Europe Limited, a limited liability company incorporated under the laws of the United Kingdom, company ID number 05139966 (hereinafter referred to as the „Partner”).
1.2. These General Terms and Conditions are elaborated and are publicly announced from the date of beginning of the Campaign and freely accessible on the mobile application Hobo during the whole period of the Promotion in compliance with the applicable Bulgarian legislation.
1.3. The Organizer shall retain the right to supplement or amend the General Terms and Conditions; any amendments shall come into force upon announcement on the mobile application Hobo.
1.4. By registration and usage of a Visa card as payment instrument on the mobile application Hobo, the participant accepts and agrees with these General Terms and Conditions including their supplements and amendments in effect as of that time.
2. DURATION OF THE CAMPAIGN. PLACE OF IMPLEMENTATION
2.1. The Campaign shall take place during the period from 20.04.2021 to 15.07.2021, incl.
2.2. The Campaign will be implemented via Hobo mobile application (hereinafter referred to as „Hobo and/or mobile application), which could be downloaded free of charge from Google Play or App Store.
3. PARTICIPANTS IN THE CAMPAIGN
3.1. All natural persons, cardholders of Visa cards, debit or credit cards, issued in Bulgaria shall be eligible to participate in the Campaign, excluding the employees of the Organizer and Visa, their subsidiary companies or anyone professionally involved in the realization of the Campaign and their family members (“Eligible Participants”).
3.2. In order to participate in the Campaign each eligible participant must download the mobile application Hobo on its mobile device or tablet from Google Play or App Store, respectively to update the mobile application Hobo if downloaded prior the commencement date of the Campaign, and register its valid Visa card in the payment section of the mobile application unless such registration has been already taken place.
3.3. In order to use Hobo mobile application and Hobo’s services each eligible participant must observe the Rules published on www.hobo.bg/en/terms.
3.4. The Organizer may at its own discretion exclude a participant from participation in the Campaign if the respective participant does not meet the requirements of these General terms and conditions and/or performs or tries to perform misappropriation for receiving discounts.
4. MECHANISM OF THE CAMPAIGN
4.1. In order to participate in the Campaign each eligible participant must register its own Visa card as payment instrument in the mobile application Hobo. If the participant has registered its Visa card as payment instrument in the Campaign before the commencement date of the Campaign, a new registration shall not be necessary.
4.2. Each eligible participant may register unlimited number of Visa cards as payment instrument in the mobile application.
4.3. Registration of a Visa card as payment instrument in the mobile application may be realized in the section “Add payment method” where the client must fill the following information: number of the card, name of the cardholder, month and year of validity of the card, CVC number. Upon validation of the registration of a Visa card the payment instrument shall be indicated in section “Payment method” on the mobile application. The card is registered, validated and used in compliance with the General Terms and Conditions of Hobo.
4.4. The registration of a Visa card as payment instrument in the mobile application is free of charge. For the purposes of validation of the registered payment instrument in case of initial registration Hobo shall charge the participant’s bank account with the sum in the amount of BGN 3.
4.5. Each eligible participant in the Campaign that has fulfilled all requirements under this section of the General Terms and Conditions and has paid services provided by Hobo via the mobile application with its registered Visa card at the minimum amount of BGN 15 during the respective phase of the Campaign, shall participate in a lucky draw for winning a prize. Services provided by Hobo via the mobile application shall be considered the following:
Participation in the prize lucky draw shall be preconditioned by the request for participation by each participant by clicking the “Sign Up” button in the “Loyalty Program” section, “Lottery” Subsection on the mobile application. By clicking the "Sign up" button, the participant agrees and accepts these General Terms and Conditions for participation in the Campaign, including their amendments and supplements, effective at the time.
4.6. A payment at minimum amount of BGN 15 performed in compliance with the requirements of these General terms and conditions shall give the right of a participation in the Campaign. A participant may win only one prize in the Campaign. A participant may participate only once in the Campaign.
5. PRIZES PROVIDED UNDER THE CAMPAIGN. PERFORMANCE OF THE LUCKY DRAW AND PROVISION OF PRIZES
5.1. Under the Campaign the following prizes shall be provided:
5.2. A prize may not be exchanged for its monetary value.
5.3. A prize may not be transferred to any third parties.
5.4. Winning participants shall be determined at random by means of the digital platform situated on https://visa.hobo.bg/lottery in the presence of a notary on 20.07.2021. There shall be one winning participant determined for each of the awards of the Campaign. Additionally to the winning participants, three reserve participants to each winner shall be determined at random who would be entitled to receive a prize under the Campaign in compliance with the terms and conditions of these General Terms and Conditions. The withdrawal of the Winning Participants and the reserves will be carried out by the Organizer, as the winning participants will be individualized through their user profiles in the Mobile Application. The winners shall be announced on https://hobo.bg/visa/lottery/winners
5.5. In 7-day term as of the performance of the lucky draw the Organizer shall contact each winner in order to receive the necessary information for provision of the prize by phone or via email. Each winner must provide its names, phone number and delivery address. If the Organizer does not succeed to contact a winner, the winner does not provide the necessary information in 2-day term as of the notification by mail/phone, or the provided information is inaccurate, the prize shall be provided to a reserve winner (prizes to reserve winners shall be provided in the order of their determination). Prizes shall be delivered by the Organizer to a delivery address provided by the winners by a courier company appointed by the Organizer. If the value of a prize exceeds BGN 100 the Organizer shall be obligated to declare, withhold and pay to the National Revenue Agency at its own expense the tax due related to the provision of the prize by the end of the month following the quarter of the year in which the respective income is acquired by the natural person (i.e. the prize is provided). For such purposes each winner shall be obligated to provide the Organizer its full names and personal identification number. For provision of prizes of insignificant value (under BGN 100) tax is not due. Refusal for provision of the necessary personal data on part of a winner shall lead to impossibility to receive a prize. In such case the prize shall be provided to a reserve winner. All personal data provided by the participants shall be used only for the purposes of the Campaign, for identification of the participants, delivery of prizes, declaration of acquired income and payment of the respective tax due.
5.6. Prizes shall be delivered for free by a courier company to the respective winner in person no later than 30 days after provision of the necessary information for provision of the prize by the winner. The prize shall be delivered to the address only once. In case at the time of the delivery the winner is not available at the delivery address the winner shall receive an SMS or a phone call with further instructions on delivery and receipt of the prize by the courier company. A prize which is not received in the additionally provided period shall be provided to a reserve winner. Upon delivery of the prize the winner shall be obligated to enter 2 copies of a delivery protocol certifying the receipt of the prize or sign a return receipt. The prize may be received in person.
5.7. The organizer shall not be liable for prizes not received due to the provision of the wrong delivery address, failure to provide one or because the winner was not found at the address specified by him at the time of delivery and therefore did not go to pick up the shipment from a courier office in specified for this time by the courier.
6. TERMINATION OF THE CAMPAIGN
This Campaign may be terminated in case of occurrence of any events that constitute force majeure circumstances and/or in case of failure by the Organizer to comply with its commitments under the Campaign due to reasons beyond its control, including any amendments to the statutory requirements and / or material abuses and / or violations of these General Terms and Conditions are established. In these cases, no compensation is due to the participants.
7. PERSONAL DATA PROTECTION
7.3. The Organizer will process only personal data of the Winning Participants and only for the purposes of sending / delivering the prizes. In this sense, the Organizer will process the following personal data:
7.3.1. The organizer may share personal data under item 7.3. of the Winning Participants to courier service providers to perform the transmission / delivery of the Winning Participants' prizes. The described personal data will not be disclosed to other persons.
7.4. The winning participants agree that their names will be published on the website: https://hobo.bg/visa/lottery/winners.
7.5. The organizer processes the personal data in accordance with the Bulgarian legislation and its policy, published in the mobile application, on the basis of the consent given by the participants.
7.6. Campaign Participants are guaranteed the rights provided for in the applicable legislation regarding the protection of personal data and their portability, including the right to information, the right of access to data, the right to intervene in the data and the right to object to the processing. Each Participant has the right to access the personal data processed by the Organizer and the right to request deletion, correction or restriction of data, as well as to realize data portability by sending a written request to the Organizer at the address of management, personally by the individual or by a proxy with a notarized power of attorney.
7.7. By participating in the Campaign, the Participants are informed that their personal identification data is used and stored in a database that can be used by the Organizer or its subcontractors, subsequently for the purposes of the Campaign. Each participant has the right to withdraw at any time his consent to the processing of his personal data by sending a written application to the Organizer at the address of management personally by the individual or by a proxy with a notarized power of attorney. The data is stored for up to six months after the termination of the Campaign or the expiration of the limitation period for fulfillment of public obligations of the Organizer in connection with the Campaign.
7.8. Refusal or withdrawal of the consent for collection, processing and use of personal data of a Participant may lead to impossibility to receive a prize in the Campaign.
7.9. Every Participant has the right to refer to the Commission for Personal Data Protection in cases when his rights under this section have been infringed.
7.10. To exercise their rights, participants can contact the Administrator at email@example.com. If a participant has a complaint or doubt about the way his personal data is used, he can contact the Administrator at firstname.lastname@example.org and he will try to resolve the issue as soon as possible. The participant has the right to file a complaint to the national supervisory authority at any time - the Commission for Personal Data Protection of the Republic of Bulgaria. 8.1. By participating in this Campaign the participants agree to comply with and observe all provisions and conditions of these General Terms and Conditions.
8.2. These General Terms and Conditions are subject to and interpreted in accordance with the legislation of the Republic of Bulgaria.
8.3. Any hypothetical disputes regarding the implementation of this Campaign shall be settled amicably. Otherwise they will be referred to the respective competent authority in Sofia.
9.1. The Organizer and the Partner shall not be held liable or owe any compensation in case the participants in the Campaign fail to obtain the prizes within the term or under the conditions specified in these General terms and conditions due to reasons unrelated to the Organizer or the Partner.
9.2. The Partner shall not be liable for technical problems related to using the mobile application or to actions of the Organizer or third parties.
9.3. The Organizer shall not be liable (to the extent permitted by law) for any losses or damages resulting from the organization of the Campaign or from the participation of any Participant in the Campaign, or if the Campaign does not take place as provided.
9.4. The organizer shall not be liable for technical problems with the use of payment cards and / or internet connectivity.
9.5. The organizer shall not be liable if a payment card is not accepted.
9.6. In case of attempts to defraud the mobile application Hobo, abuse and / or actions of any nature to affect the image of the Organizer, the latter reserves the right to take all necessary measures to eliminate the situation.
